The widow of a man who was allegedly shot and killed during a pursuit last April has filed a wrongful death lawsuit against White County, Sheriff Oddie Shoupe and two officers.
The legal action was filed Feb. 2nd by attorneys representing Robin Spainhoward, the widow of Michael Dial.
According to the lawsuit, Dial was pulled over for driving on a suspended license in DeKalb County and was told he was not free to drive. However, Dial was seen driving his 1976 pickup truck pulling a fully loaded trailer. Dial led officers on a pursuit along Highway 70 into White County, at which time officers from White County and Sparta Police joined the pursuit.
The chase continued on to Highway 111 as White County officers were trying to stop Dial by utilizing the pit maneuver. The lawsuit states Sheriff Shoupe ordered his officers to use deadly force.
Dial’s vehicle was eventually forced off the road and Dial was allegedly shot and killed by officers.
The plaintiff is demanding a jury trial.
